Dog Photography & Video Production at Chasing Flow Photography (DancingK9 AB)

These Terms & Conditions apply between the Photographer and the Client when booking a photography session, video production, or purchasing photographs.

By booking a session, ordering photographs, or purchasing digital products, the Client agrees to these Terms & Conditions.

1. Booking and Agreement

A booking becomes binding once the Client has accepted a quotation, booked through the booking system, or received written confirmation from the Photographer.

The agreement is made between the Photographer and the person named on the booking.

The Client is responsible for providing accurate information, including:

  • Contact details

  • The dog's name and relevant information

  • Any special requirements

  • Preferences regarding the photography session

2. The Photography Session

The Photographer works according to their own artistic style and creative vision.

The Client understands that the final result may be influenced by factors such as:

  • The dog's behaviour and condition on the day

  • The location

  • Lighting conditions

  • Weather

  • Surroundings and distractions

The Photographer cannot guarantee specific photographs, moments, tricks, poses, or expressions.

For action photography, specific movements, jumps, or competition moments cannot be guaranteed to be captured.

3. Dog Safety and Responsibility

The owner is always responsible for their dog during the photography session.

The Client is responsible for ensuring that:

  • The dog is healthy and suitable for photography

  • The dog remains under control at all times

  • The Photographer is informed of any special needs, fears, reactivity, or other circumstances that may affect the session

The Photographer reserves the right to modify or terminate the session if the situation is considered unsafe for the dog, people, or equipment.

The Photographer is not liable for any damage or injury caused by the actions of the Client or the dog.

4. Rescheduling and Cancellation

If a booking is cancelled later than 7 days  before the scheduled session, the booking fee may be retained, as the Photographer has reserved that time for the Client.

Late cancellations may incur additional charges if the reserved session cannot be replaced with another booking.

Illness, injury, or exceptional circumstances will be assessed on a case-by-case basis.

Rescheduling is subject to availability.

5. Weather and External Circumstances

For outdoor sessions, weather and environmental conditions may affect the outcome.

The Photographer and Client will jointly decide whether the session should be rescheduled due to circumstances such as:

  • Heavy rain

  • Extreme temperatures

  • Poor lighting conditions

  • Safety concerns

6. Payment Terms

Prices are stated in the current price list, quotation, or booking confirmation.

Payment shall be made according to the agreed terms.

Photographs and video material will be delivered only after full payment has been received.

In the event of non-payment, the Photographer reserves the right to withhold delivery until payment has been made in full.

7. Delivery

Photographs and videos are delivered digitally via an online gallery or another digital delivery service.

The estimated delivery time will be communicated at the time of booking.

Delivery times may be affected by:

  • Peak season

  • Competition schedules

  • Larger assignments

  • Illness or unforeseen circumstances

8. Image Selection and Editing

The Photographer is solely responsible for selecting the images to be delivered.

Delivered images are fully edited according to the Photographer's artistic style.

RAW files, unedited originals, and images not selected for delivery will not be provided.

9. Digital Images and Additional Products

The Client receives the images and products included in the selected photography package.

Additional images may be purchased according to the current price list.

Digital files are delivered in the quality and format deemed appropriate by the Photographer for the intended use.

10. Copyright

The Photographer retains full copyright to all photographs and videos in accordance with Swedish Copyright Law.

The purchase of photographs does not transfer copyright ownership to the Client.

11. Client Usage Rights

The Client receives a personal, non-exclusive licence to use the delivered images for private purposes.

Permitted uses include:

  • Personal social media

  • Personal website or blog

  • Printing

  • Private photo albums

Commercial use requires a separate written agreement and licence.

12. Restrictions on Editing and Alteration

The delivered photographs represent the Photographer's finished artistic work.

The Client may not alter, manipulate, or edit the photographs in a way that changes the Photographer's original work without prior written permission.

This includes, but is not limited to:

  • Significant cropping that changes the composition

  • Applying filters or colour adjustments

  • Retouching or other image editing

  • AI-generated alterations, additions, or removal of elements

  • Changes affecting the dog's appearance, the environment, or the Photographer's artistic expression

The Photographer's signature, watermark, or other identifying marks may not be removed or altered.

When publishing on social media, automatic cropping performed by the platform is permitted, but the Client may not intentionally modify the photographs using filters or other editing tools.

If alternative cropping or editing is required for a specific purpose, the Photographer should be contacted.

13. Commercial Use and Licensing

Photographs and videos may not be used commercially without the Photographer's prior written approval.

Commercial use includes, but is not limited to:

  • Business marketing

  • Advertising

  • Sponsor material

  • Products

  • Sales

  • Promotional campaigns

A separate commercial licence fee may apply.

14. Photographer's Right to Use the Material

Unless otherwise agreed, the Photographer reserves the right to use photographs and videos from the session for:

  • Portfolio

  • Website

  • Social media

  • Marketing and promotional purposes

If the Client does not wish the material to be published, this must be communicated before the photography session.

15. Competition and Event Photography

For competition or event photography, the Photographer cannot guarantee that every competitor, performance, or requested image will be captured.

Image selection depends on factors including:

  • Location

  • Lighting

  • Timing

  • Technical conditions

  • The movement of the dog and handler

Photographs are available for purchase according to the current price list.

16. Video Production

The same terms apply to video assignments regarding:

  • Booking

  • Payment

  • Delivery

  • Usage rights

Unless otherwise agreed, only the finished edited video will be delivered.

Raw footage will not be provided.

17. File Storage

The Photographer stores photographs and video files for a limited period following delivery.

After this period, files may be permanently deleted without notice.

The Client is responsible for creating backups of all delivered files.

18. Force Majeure

The Photographer shall not be held liable for delays, cancellations, or failure to fulfil the agreement due to circumstances beyond the Photographer's reasonable control, including but not limited to illness, accidents, technical failures, or extreme weather conditions.
